01. Collection of your Personal Information

In order to better provide you with products and services offered on our Site, HivePowered.Ai may collect personally identifiable information, such as your:

• First and Last Name
• Mailing Address
• E-mail Address
• Phone Number, including mobile phone number
• SMS consent records, where you have opted in to text messaging. This includes your consent status, the date and time consent was given, the web page or form on which it was given, and the disclosure language presented to you at that time.
• Any and all information that is entered into our systems, contact fields, contact forms. This includes the custom creation of 'custom fields' by both staff and our site users.

If you purchase HivePowered.Ai's products and services, we collect billing and credit card information. This information is used to complete the purchase transaction.

HivePowered.Ai may also collect anonymous demographic information, which is not unique to you, such as your:

• Household Income
• Our company does not collect information on age, gender, race, religion, political affiliation, but our customers may create custom data fields in their own accounts to gather such data. We are not responsible for data that our customers create. We only collect required data for employment, client account creation and billing purposes.

We do not collect any personal information about you unless you voluntarily provide it to us. However, you may be required to provide certain personal information to us when you elect to use certain products or services available on the Site. These may include: (a) registering for an account on our Site; (b) entering a sweepstakes or contest sponsored by us or one of our partners; (c) signing up for special offers from selected third parties; (d) sending us an email message; (e) submitting your credit card or other payment information when ordering and purchasing products and services on our Site. To wit, we will use your information for, but not limited to, communicating with you in relation to services and/or products you have requested from us. We also may gather additional personal or non-personal information in the future.

02. Use of your Personal Information

HivePowered.Ai collects and uses your personal information to operate its website(s) and deliver the services you have requested. HivePowered.Ai may also use your personally identifiable information to inform you of other products or services available from HivePowered.Ai and its affiliates.

Mobile phone numbers and SMS consent data are treated differently. Where you have provided a mobile number and opted in to text messaging, that mobile information is used solely to deliver the text messages described in Section 04 of this Policy and to maintain a record of your consent and any opt‑out request. Mobile information is not used to promote the products or services of any affiliate or third party.

03. Sharing Information with Third Parties

HivePowered.Ai does not sell, rent, or lease its customer lists to third parties.

HivePowered.Ai may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. In those cases, your unique personally identifiable information (e-mail, name, address, telephone number) is not transferred to the third party. HivePowered.Ai may share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to HivePowered.Ai, and they are required to maintain the confidentiality of your information.

The sharing described in the paragraph above does not apply to mobile information or SMS consent data. Mobile information is governed exclusively by Section 04 of this Policy and is never shared with third parties or affiliates for marketing or promotional purposes.

HivePowered.Ai may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on HivePowered.Ai or the site; (b) protect and defend the rights or property of HivePowered.Ai; and/or (c) act under exigent circumstances to protect the personal safety of users of HivePowered.Ai, or the public.

04. SMS/Text Messaging

How we obtain SMS consent

INSPIRE UNLIMITED LLC (DBA HivePowered.Ai) collects mobile phone numbers and SMS consent through opt‑in forms on hivepowered.ai and its subdomains, and through application and contact forms we host on behalf of our clients. On these forms, SMS consent is collected using a separate checkbox that is unchecked by default and dedicated solely to text messaging. It is not bundled with acceptance of our Terms and Conditions, with email marketing consent, or with any other permission. Providing SMS consent is optional and is never a condition of purchase, of receiving any service, or of employment consideration. You may submit any form and use our services without checking the SMS consent box. We do not purchase, rent, or import mobile numbers from third party lists for text messaging purposes.

What messages you may receive

Messages may include appointment confirmations and reminders, account and service notifications, support responses, and recruiting or onboarding communications, depending on the program you opted in to.

Message frequency

Message frequency varies based on your interaction with us and the services you have requested.

Message and data rates

Message and data rates may apply. Standard charges from your mobile carrier apply to all messages sent and received. Carriers are not liable for delayed or undelivered messages.

Opting out

Reply STOP to any message to end SMS communication at any time. You will receive a single confirmation message and no further texts unless you opt in again. We also honor QUIT, END, REVOKE, OPT OUT, CANCEL and UNSUBSCRIBE. You may additionally contact our customer support representatives and ask to be manually opted out (DND, Do Not Disturb, and removed from all campaigns) by emailing [email protected] or calling (530) 830-2883.

Retention of consent records

We retain records of your SMS consent and of any opt‑out request for as long as required to demonstrate compliance with applicable law and carrier requirements. Retaining an opt‑out record is what allows us to ensure you are not contacted again, and such records are kept even after you opt out.

05. Right to Deletion

Subject to certain exceptions set out below, upon receipt of a verifiable request from you, we will:

• Delete your personal information from our records; and
• Direct any service providers to delete your personal information from their records.

Please note that we may not be able to comply with requests to delete your personal information if it is necessary to:

• Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;
• Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;
• Debug to identify and repair errors that impair existing intended functionality;
• Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;
• Comply with the California Electronic Communications Privacy Act;
• Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent;
• Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;
• Comply with an existing legal obligation, including the retention of SMS opt‑out records described in Section 04; or
• Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.

06. Children Under Thirteen

HivePowered.Ai does not knowingly collect personally identifiable information from children under the age of thirteen. If you are under the age of thirteen, you must ask your parent or guardian for permission to use this website. We do not knowingly collect mobile numbers from, or send text messages to, anyone under the age of thirteen.

07. Disconnecting your HivePowered.Ai Account from Third Party Websites

You will be able to connect your HivePowered.Ai account to third party accounts. BY CONNECTING YOUR HIVEPOWERED.AI ACCOUNT TO YOUR THIRD PARTY ACCOUNT, YOU ACKNOWLEDGE AND AGREE THAT YOU ARE CONSENTING TO THE CONTINUOUS RELEASE OF INFORMATION ABOUT YOU TO OTHERS (IN ACCORDANCE WITH YOUR PRIVACY SETTINGS ON THOSE THIRD PARTY SITES). IF YOU DO NOT WANT INFORMATION ABOUT YOU, INCLUDING PERSONALLY IDENTIFYING INFORMATION, TO BE SHARED IN THIS MANNER, DO NOT USE THIS FEATURE.

This feature does not release mobile information or SMS consent data. As stated in Section 04, text messaging originator opt‑in data and consent are excluded from all third party sharing.

You may disconnect your account from a third party account at any time. If a user needs help to 'integrate' or 'disconnect' access with other third party sites, they can email us at [email protected] and a customer service representative will assist them.

08. E-mail Communications

From time to time, HivePowered.Ai may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. In order to improve our Services, we may receive a notification when you open an email from HivePowered.Ai or click on a link therein.

If you would like to stop receiving marketing or promotional communications via email from HivePowered.Ai, you may opt out by clicking the "UNSUBSCRIBE" link in any email. Customers can also contact our customer support representatives and ask to be manually opted out (DND, Do Not Disturb, and remove from all campaigns). Email consent and SMS consent are collected separately and are managed separately. Unsubscribing from email does not end text messages, and replying STOP to a text message does not end email. To stop text messages, see Section 04.

09. External Data Storage Sites

We may store your data on servers provided by third party hosting vendors with whom we have contracted. These vendors act as subcontractors providing support services to us and are prohibited from using your information for any purpose other than delivering those services.

10. Changes to this Statement

HivePowered.Ai reserves the right to change this Privacy Policy from time to time. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your account, by placing a prominent notice on our site, and/or by updating any privacy information on this page. Your continued use of the Site and/or Services available through this Site after such modifications will constitute your: (a) acknowledgment of the modified Privacy Policy; and (b) agreement to abide and be bound by that Policy.

11. Limitation of Liability

To the maximum extent permitted by law, INSPIRE UNLIMITED LLC (DBA HivePowered.Ai) shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if HivePowered.Ai has been advised of the possibility of such damages) resulting from the use of, or the inability to use, the Site or Services. In no event shall HivePowered.Ai's total liability to you for all damages, losses, and causes of action (whether in contract, tort, or otherwise) exceed the amount paid by you, if any, for accessing the Site or using the Services.
